Despite the stock market downturn over the last 9 months, IRAs continue to be a significant part of the asset base of many clients. As such, the issue of the taxation of distributions remains a focus of practice.  In addition, since 2020 when the SECURE Act gave us a new set of rules governing distributions from IRAs the estate planning impact of these accounts has become a major focus.  Even for older individuals who face long-term care decisions, ownership of IRAs can create issues that must be addressed.  This session will review the tax rules related to distributions, focus on the recent and proposed changes in the planning landscape, and discuss how IRAs impact later in life decisions.

The launch of Bitcoin in early 2009 seemed at the time like a blip on the world’s radar screen. For those who weren’t fervent early adopters of the digital medium of exchange, the concept was hard to understand and even harder to use. Today, the world of blockchain technology has evolved to include cryptocurrencies like Bitcoin, Ether, non-fungible tokens, decentralized finance, decentralized autonomous organizations (DAOs), and the various Metaverses in corners of the Internet large and small. For tax practitioners who haven’t waded knee-deep into this space, the vocabulary and the mechanics can seem overwhelming.  If you’re confused, you’re certainly not alone among the private sector, and even the government has been unsure about how to treat these novel ideas for tax, securities, and other purposes. This presentation will introduce the basic concepts in detail and cover the fundamentals about the associated tax issues, both resolved and unresolved.

Course 3042 - Pension Risk Transfer

Friday, November 18 @ 12:40 PM
(1 CPE SK)
Steve J. Musmanno, MBA, AIFA®, CIO

The transferring of risk from defined benefit pension plans (often called “de-risking”) has become a focus of pension plan providers, participants, and policymakers over the past few years. The Pension Committee of the American Academy of Actuaries believes that discussion of risk transfer from the perspectives of different constituents affected by these transactions will help to educate plan sponsors, regulators, fiduciaries, and policymakers and provide greater clarity regarding this topic.

The types of risks addressed in pension transfer transactions might include the following: • The risk that participants will live longer than current annuity mortality tables would indicate (longevity risk). • The risk that funds set aside for paying retirement benefits will fail to achieve expected rates of investment return (investment risk). • The risk that changes in the interest rate environment will cause significant and unpredictable fluctuations in balance sheet obligations, net periodic cost, and required contributions (interest rate risk). • The risks of a plan sponsor’s pension liabilities becoming disproportionately large relative to the remaining assets and liabilities of the sponsor.

Owners of closely-held businesses may struggle to find liquidity options that meet their nuanced continuity and legacy goals. This conflict can inhibit transactions and complicate attempts to de-risk concentrated portfolios.  Employee stock ownership plans (ESOPs) represent a tax-advantaged liquidity alternative, enabling shareholders to get “chips off the table” while maintaining upside and a meaningful role with their companies.

This program will examine ESOP sales vis-à-vis other diversification options and offer of a detailed discussion of plan structure, tax benefits, and estate planning compatibility. Appropriate situations for ESOP utilization - supported by several case studies – will also be reviewed.

Course 3054 - Newton’s Laws of Motion – The Real Application to Executing Through Change in Your Fir

Friday, November 18 @ 2:30 PM
(2 CPE ADVISORY)
William Hill, MBA, CLTC

While I am quite sure that the genius Sir Isaac Newton was in no way thinking about tax and accounting firms, his Laws of Motion are greatly insightful for helping your tax and accounting firm move through the constant churn of change we face today. More than ever, we are pressed with change from every side: clients, government regulation, staffing, and the general business/economic climate. With change many picture chaos and confusion. Others are just looking for steady motion and avoid change where they can simply out of being tired. But for your firm to grow in strength and service to clients, the changes around cannot be ignored but must be leveraged.

In this session we will dig into each of Newton’s Laws of Motion and share proven strategies and practical ways for your firm to use these to your advantage in executing and exceling through change. Bring your list of current changes at your firm, and the things you have thought about changing – and be ready to confidently act on those as you leave the session.
